How do I decide where a natural person is resident?

For most personal lines policies the insured is resident in the jurisdiction given in their address, appearing in the slip or the policy schedule.

Questions can sometimes arise when an insured is moving between different jurisdictions, such as servicemen and women and other persons whose occupations require them to spend large amounts of time in different parts of the world. The standard EU definition of the 'Member State in which a risk is situated' refers to the Member State in which the insured is 'habitually resident'. In the UK, guidance provided by HM Revenue & Customs suggests that living in the UK for one year or more constitutes 'habitual residence'. Other fiscal authorities have not produced similar guidance, but, unless such guidance is provided subsequently, this approach may be adopted generally.
