When deciding the location of risk for insurances of off-shore property it may be necessary to ascertain whether the property concerned is in a country’s territorial waters.

These insurances include elements of property and liability insurance. The location of risk should be determined by the location of the insured’s establishment most closely associated with the risk. As an oil or gas rig constitutes an “establishment”, this will be the rig or rigs forming the subject matter of the insurance.
